§ 40-714. Inspections.

  • (a)

    Access for inspection, observation, measurement, etc. Agents of the utility or of the MMSD shall be allowed access to all monitoring facilities and property served by the utility for the purpose of inspection, observation, measurement, sampling and testing of discharges to the utility sewers and MMSD wastewater facilities; or for the purpose of inspection of records kept by industrial users relating to pretreatment requirements or reporting thereof.

    (b)

    Agents to bear credentials. Agents of the utility exercising authority under this subsection shall bear proper credentials and identification.

    (c)

    What information to constitute public record. Any effluent data submitted or supplied to the utility by any person or user is a public record within the meaning of Wis. Stats. § 19.21. All other information submitted to the utility shall be a public record unless the information is entitled to confidential treatment pursuant to Wis. Stats. § 283.55 and Wis. Admin. Code § NR 2.19. The utility may require any industrial user to provide information about industrial processes which may have an effect on the nature or composition of the industrial discharge and such information will be kept confidential if the requirements of the aforesaid statutes and administrative rule are satisfied. Any information or data obtained by the utility which is confidential or constitutes a trade secret shall not be disclosed to unauthorized persons.

    (d)

    Surveys. In accordance with Wis. Stats. § 200.11 and this article, the MMSD director or his/her authorized or employees shall be permitted to enter upon any lands in the utility for the purpose of making surveys or examinations.
