§ 40-54. Appeal to the city council.

  • Any person who objects to any final decision of the board after appeal to the board may appeal to the city council.

    (1)

    A written notice of appeal shall be filed with the city clerk within 14 days of the date when notice of the final decision of the board is mailed.

    (2)

    The notice of appeal shall state the action of the board appealed from, shall specify the reasons stated by the board for taking such action, and shall specify why the appellant believes said action was inappropriate.

    (3)

    The city clerk shall file the notice of appeal with the common council and shall schedule the appeal for consideration by the common council at a meeting open to the public, within 45 days of the filing of the notice of appeal. The clerk shall send notice of the time scheduled for the consideration of the appeal to the appellant and the secretary of the board.

    (4)

    Within 30 days of the appeal hearing, the common council shall affirm, modify, or reverse the action of the board or shall refer the matter back to the board for further consideration. Notice of the decision of the common council shall be sent to the appellant and the board.
